Requirements

Banks and financial institutions have been subject to the verification of identity requirements introduced by the Anti-Money Laundering and Counter Financing of Terrorism Act 2009 (AML/CFT Act) since 2013.

Since 1 July 2018, the AML/CFT Act was amended to also require lawyers, accountants and real estate agents to verify the identity of clients and any persons acting on their behalf. This is achieved through regulated customer due diligence processes.

The intent of the AML/CFT Act is to better protect New Zealand against criminal activity and enhance our international reputation as a safe place to do business.

How does the AML/CFT Act affect you as a client?

Just like banks, the AML/CFT Act requires that we collect identification information on you our client and anyone acting on your behalf. The information needs to show your name, date of birth and proof of address. In some situations the source of wealth or funds may also need to be proven. How to provide this information

If you are a new client you will need to bring ID with you when you first meet with us. We will also take a copy for our records. If you are unable to visit in person we can accept a certified copy of the original document, or may even be able to verify your identity through our on-line compliance process.

When to provide this information

The verification of identity must take place before we can start work on your behalf when undertaking work in respect of matters involving property or business sale and purchase, formation of trusts and legal entities, matters involving the transfer of funds or business and trust related matters.
